1. Overview
This Customer Service Agreement ("Agreement") outlines the terms and conditions governing the live coaching call ("Coaching Session") provided by Alek Cervantes to the Customer. By participating in the Coaching Session, the Customer agrees to abide by the terms and conditions outlined herein.
2. Coaching Session
2.1 Scope: The Coaching Session shall consist of a live Zoom call, during which Alek Cervantes will provide coaching, guidance, and insights related to the car buying process.
2.2 Duration: The Coaching Session will occur on date provided by Alek and is expected to last over 90 min.
2.3 Recording: The Coaching Session may be recorded for training and quality assurance purposes.
3. Payment and Fees
3.1 Payment: The Customer agrees to pay the specified fee for the Coaching Session prior to the scheduled date. Payment details and options will be provided separately.
3.2 Refunds: Refunds will not be issued once the coaching call has commenced.
4. Confidentiality
4.1 Customer Information: The Customer acknowledges that they may share personal and confidential information during the Coaching Session. Alek Cervantes agrees to maintain the confidentiality of all information shared during the Coaching Session.
4.2 Recording Access: The Customer acknowledges that they may request access to the recording of the Coaching Session, subject to the conditions outlined in this Agreement. Sharing, distributing, or disseminating the recording in any form without explicit consent is strictly prohibited, and violators may be subject to legal action to the fullest extent.
5. Liability
5.1 Limitation of Liability: Alek Cervantes shall not be held liable for any direct or indirect damages, including but not limited to, financial losses, arising from the Coaching Session.
5.2 No Guarantee: Alek Cervantes does not guarantee specific results from the Coaching Session, and any decisions or actions taken by the Customer based on the Coaching Session are the sole responsibility of the Customer.
6. Dispute Resolution
6.1 Mediation and Arbitration: In the event of any dispute arising from this Agreement, both parties agree to attempt mediation and, if necessary, binding arbitration in accordance with the rules and regulations of the jurisdiction governing this Agreement.
7. Amendments
7.1 Modification: This Agreement may only be modified in writing and signed by both parties.
8. Entire Agreement
8.1 Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether oral or written.
By checking the box and participating in the Coaching Session, the Customer acknowledges that they have read, understood, and agreed to the terms and conditions of this Customer Service Agreement.
